These WR HOA Bylaw changes are being proposed by the Board of Directors.
Over the past eight years, since the last revision to our bylaws, both Colorado and Federal laws have changed to the point our documents need updating. The most recent Colorado law changes became effective August 2024.
Last year, the attorney who represented us advised that our governing documents, i.e., bylaws and covenants, were not current. They were somewhat confusing, sometimes contradictory to each other, and did not follow recent Colorado laws. Our secretary attended several seminars and webinars and agreed our documents needed updating. With these things in mind, the Board asked our current legal advisor to review our bylaws.
We contracted with his firm to review and amend our documents to follow current Federal and Colorado laws. These changes also include more definitions of terms which have previously been used but not defined. They also remove several ambiguities and make clarifications. (Proposed changes are followed by BOLD black print to highlight what or why a change was deemed necessary).
We hope you will read this document and consider the advantages to having a governing document that is clear and legally sufficient to protect all of our interests!
A vote will take place at the annual meeting on October 26, 2024. Edited to add: A vote was held and the bylaws revision failed to pass.
