UNAPPROVED

Ken Bonitz called the meting to order at 7:03 PM, 13 Nov 2003. Board members present included: Ken Bonitz, Bob Lorenz, Jim Montgomery, Chad Boekes, Gary Fish and Mike Coulup.

Item 1: John and Linda Celestre's Request for building variance. Ref: Lot 29 Filing 2; 4297 Wavy Oak Drive. Linda presented a request for a building variance (of the 50ft setback to a lot line) for the purpose of construction of a detached garage/workshop/studio. The proposed location of the structure is within 12 ft of the lot line (to the west of their house). Linda discussed the reasons for the proposed location versus other locations on their lot and presented a letter from Rich and Joni Swinford (neighbors to the west) saying that they agreed with the proposed location. Linda also discussion that if the DRC grants a waiver, they still will have to request a waiver of the county's 25ft setback requirement. Linda has already shown the plans to the county and they had indicated that the variance (when submitted) would probably be approved. Bob Lorenz motioned to approve the variance contingent upon the Celestre's receiving county variance approval. Discussion: Ken Bonitz suggested amending the motion to include DRC plan approval as well. Vote: All Board members voted to approve the motion as amended by Ken Bonitz.

Item 2: Gary Fish began a discussion of the Fire Service in the local area based on the recent local vote. Question was basically did we lose fire service? Much discussion ensued over many topics including an early Glen Jack's fire agreement. Bob Lorenz motioned that the board assign someone to investigate the fire issues and present their findings to the board at a later date. Ken Bonitz seconded the motion. Discussion: Ken Bonitz volunteered to gather information and report back to the board. Vote: All Board members voted to approve the motion, Ken Bonitz to take the action and report back

Item 3: DRC Report. Jim Montgomery submitted a list of six new houses the DRC has approved to Chad Boekes. Additionally we discussed the process to verify external water meters are in place on new construction - DRC should conduct a 'walk around' prior to closing, and how to verify landscaping was built to plan - again, conduct a walk around and report any non-compliance to the covenant committee.

Item 4: Treasury Report by Chad Boekes.
- $29997 in the bank
- No outstanding bills
- Seven Home Owner dues outstanding, 6 on empty lots, one in foreclosure We discussed how to get homeowners to pay dues in a timely manner. Chad is going to add words on the invoices sent out to the homeowners indicating when the payment is due and that interest may accrue for late payments. In a discussion of collection of outstanding dues/ interest, the board felt that the payments could be gathered at time of sale/purchase closing process. We also discussed the upcoming budget and agreed that at the Dec meeting we will review the budget items in preparation for presentation and vote on the budget at the Jan 2004 meeting.

Item 5: Covenant Committee Report. Gary Fish presented a status report containing five items.

  1. Walker property @ 20275 Roaming now has an external water meter.

  2. Gyetvan property @ 20425 Lockridge has moved his trailer out of sight.

  3. The Hoffman Construction sign has been removed from 19975 Twisted Oak.

  4. Report of trailers in the yard at the following addresses:
  • 20320 Lockridge: Gary saw no trailer at this address, turned out the wrong address was submitted, correct address is 20420 Lockridge, Gary to check it out and report back.

  • 20120 Twisted Pine: Gary requested board members to drive by the house (Tudor up on hill) and report back. His feeling was that the trailer was barely visible.

  • 19720 Twisted Pine: Gary reported trailer has been moved, nothing observed here.

  • 20175 Wissler Ranch: Much discussion of trailer movement at this property. Gary to talk to them to work out a permanent solution.

  • 20075 Wissler Ranch: Report of lawn tractor with trailer left out in view. Gary also to go talk to them to work out a solution.
  1. 5. Trash / Dead trees reported in the common area. Mike Coulup to take a look at debris and remove if possible.

Additional details were provided on the trash/dead trees in the common area, and it was determined that a separate action may be required on the property at the corner of Palmer Divide / Lockridge, backing up to the common area. More Slash debris was reported either on that lot or possibly on the common area. Gary to check it out and report back.

Item 6: Landscape Committee Report. Discussed the landscaping ideas presented at the annual meeting, what's the next steps and how do we present it to the community. Ken Bonitz, Mike Coulup and Bob Lorenz took the action to come up with several options and approximate costs that could be presented to the community. Ken reported that the preliminary numbers coming back from the water meter reading showed as a community we used about ~38% of our total water allotment based on 91 or the 133 lots reporting. The average homeowner is using 55-60% of their allotment. Ken reported that there several issues and anomalities that need to be addressed before the final number can be submitted. There was also discussions on water features, what you can and can't have and how the water to fill them mush be provided. Ken Bonitz reported that the board is developing a water usage policy.

Item 7: Election of Officers. Chad Boekes nominated (in mass) the following: President: Mark Cookson, Vice President: Ken Bonitz, Treasurer: Chad Boekes, and Secretary: Bob Lorenz. Ken Bonitz seconded the nomination, there was no discussion and all the board members voted to approve the nominations.

Item 8: New Business.

  • Peter Popp requested that the HOA Minutes be posted to the WEB site, and that in general the WEB site be maintained in a timelier manner. Ken Bonitz took the action to talk to Shari about options.

  • Peter Popp recommended that the board obtain copies of the well permits. Chad took the action to contact Glen Jacks and pursue this.

  • Ken Bonitz reported that he learned at the meeting with the Great Divide Water Company, that Wissler Ranch owns 100 shares of the company. Ken took the action to track down the stock certificates or have new ones generated.

Bob Lorenz motioned that the meeting be adjourned, with Chad Boekes seconding the motion. All board members voted to adjourn.

Meeting was adjourned at 9:05 PM 11/13/2003.
